I really think there needs to be a court battle that will finally test the enforceability of software EULAs. The EFF and others seem pretty confident that they won't hold up. But that still leaves the problem of disclosure when a company does want to log some data. Maybe facebook's approach of letting you control exactly what parts of your personal information you are willing to share with a given app can be extended to the desktop or other websites.
